Being Sued
You've been served: what to do first
Read every page and note the deadline. The paperwork you were served should state how many days you have to respond and to which court. Write that date down immediately and treat it as non-negotiable.
Don't ignore it. If you don't respond by the deadline, the other side can typically ask for a 'default judgment,' meaning they win automatically without a hearing.
Figure out what's being alleged. Read the complaint carefully and identify each specific claim (allegation) being made against you, since your response will need to address each one.
Consider your options: file an Answer (respond point-by-point), file a motion (e.g., to dismiss or for more time), or try to resolve the matter directly with the other side or through mediation.
Use the 'Add a Case' feature in this app to start tracking your deadline right away, and the 'Answer to Complaint' or 'Motion for Continuance' templates under Documents to get a first draft started.
